Terms of Service

These Terms of Service ("Terms") govern your use of the Macooler application for macOS ("the App") and the website at macooler.com, provided by Macooler, an individual sole trader based in the Republic of Türkiye ("we", "us", "our"). By downloading, installing, or using Macooler you agree to these Terms.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Macooler on Mac computers you own or control, subject to these Terms. We retain all rights, title, and interest in and to the App, including all intellectual property rights. All rights not expressly granted to you are reserved.

2. Free and Pro

Macooler is free to download and use. Certain advanced features require a paid "Macooler Pro" subscription. The features included in the free and Pro tiers, and the plans and packages we offer, may change over time. We reserve the right to add, modify, limit, bundle, rename, or discontinue any feature, plan, or package at our sole discretion, at any time, with or without notice.

3. Subscriptions and billing

Macooler Pro is billed on a recurring monthly or yearly basis through our payment provider, Polar, which acts as the Merchant of Record for all purchases. Subscriptions renew automatically until cancelled. You may cancel at any time; your Pro access continues until the end of the current billing period. Applicable prices and taxes are shown at checkout.

We reserve the right to change subscription prices, plans, and billing terms at any time. A price change applies to renewals that occur after it takes effect; the price shown to you at purchase applies for your then-current billing period. If you do not agree to a new price, you may cancel before your next renewal. Promotional or introductory pricing applies only for the stated period and is not guaranteed to renew at the same rate.

Macooler performs system monitoring, maintenance and control operations (such as fan control and running maintenance tasks). You are responsible for maintaining backups of your data and for reviewing actions before confirming them.

6. Disclaimer of warranty

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be error-free or uninterrupted, or that it will not affect your files or system.

7. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of data, arising from your use of the App. Our total liability shall not exceed the amount you paid us for the App in the twelve (12) months preceding the claim.

8. Suspension, termination and changes to the service

We reserve the right to suspend, limit, terminate, or refuse your access to the App or to any subscription at our discretion — including for breach of these Terms, non-payment, chargeback, or suspected fraud or abuse — with or without notice. We may also modify, suspend, or discontinue the App, or any feature, plan, package, or service, in whole or in part, at any time and without liability to you. Any refund is governed by our Refund Policy and applicable law.

9. Changes to these Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Republic of Türkiye.
